Terms of Sale Agreement

I. General Conditions

Membership: Membership may be required in order to shop at sunpa.com.tr (“sunpa.com.tr”). In case of membership, you can shop at any time after becoming a member. Transactions made using the correct membership number and password are deemed to have been made by the member and all responsibility for illegal transactions belongs to the member.
Order: In order to place an order: After logging into the system, clicking on the Product Details section of the product to be ordered can reach the product information screen where product information, price, payment options, delivery and similar information are displayed. All installment/payment options and installment/payment rates, if any, of the selected product in this section can be seen in the Payment Options table. On this screen, the Buy button, which is the first step of the order, should be clicked. In the new window that will open, you can see the shopping cart and the other products, if any, including the quantity, features, VAT, discount details and the detailed amounts of the order. When you proceed with the Continue button, the “sales contract” appears with the Invoice and Delivery address entered during the Membership/Order phase. The number of installments (if any), payment/credit card options are selected on this page. After completing all the information, the Continue button that appears on the screen should be clicked. You can shop 24 hours a day, 7 days a week from sunpa.com.tr. After the shopping process is completed, a “receipt” will appear on the screen. You will be notified by automatic e-mail that your order has been accepted, that your order has been processed. If there is a problem with the receipt of this e-mail, an e-mail can be sent to the customer services address sunpa.com.tr or the customer service can be called at 0552 623 38 38. Sunpa.com.tr reserves the right to cancel orders, even if the order is placed based on technical or human errors in the product detail section.
Product Detail Information/Update: The site works completely online. Stock and price information is constantly updated. The validity period of the prices is limited to the specified period and/or stocks. All information given and quotations are for promotional purposes only. sunpa.com.tr reserves the right to change the content, photos, images and prices without notice. sunpa.com.tr cannot be held responsible for price errors caused by typesetting and system errors.
Confirmation of the Order: The Member/Customer reads the information on the essential qualities, features, sales price including taxes, payment and delivery method, and the supply and delivery times of the product/products that constitute the subject of the order/contract at sunpa.com.tr and provides all information about the product/products/services. It accepts and declares that it owns/acquires and gives approval for the purchase/shopping in electronic environment in line with this detailed information. The customer shopping at sunpa.com.tr is deemed to have read, accepted and confirmed all the terms and conditions written here and the Sales Agreement in electronic environment. The provisions of the Law No. 4077 on the Protection of the Consumer shall apply to matters that are not regulated in the written conditions in the Sales Contract.
Special Conditions: Those under the age of 18 cannot shop at sunpa.com.tr. sunpa.com.tr reserves the right to determine the buyer group for certain products or to impose some special restrictions.
Force Majeure: It does not exist at the date of approval of the order and is not foreseen by the parties, arises and develops beyond the control of the parties, prevents any of the parties from fulfilling their obligations and responsibilities written herein on time, partially or completely (natural disaster, war, terrorism, riots, legislative provisions, seizure or strike, lockout, major malfunctions in production and communication facilities...) will be considered force majeure. The party exposed to force majeure shall notify the other party of the situation immediately and in writing, and during the continuation of force majeure, the parties will not be liable for failure to fulfill their obligations. In case the force majeure continues for 30 (thirty) days, the parties reserve the right to cancel the contract/order.

II. Payment

Making a payment via sunpa.com.tr; These general terms of sale, terms of use, security and privacy of the website at sunpa.com.tr, terms of advertising etc. means that you have read and accepted the terms and conditions in the service purchase agreement.

Payment Options: Sunpa.com.tr shopping is done by credit card. sunpa.com.tr may offer EFT/bank transfer or other payment options other than credit cards, or cancel existing payment methods. By making a payment using one of the payment terms, you confirm that you are authorized to use that payment source. The processing time of the orders is the moment when sunpa.com.tr officials make the necessary examination and activate it, following the blocking of money equal to the order amount from the credit card account. Except as stated herein or explained by sunpa.com.tr, payment by postal mail or postal check is not accepted.
Online payment by Credit Card Secure payment (online) can be made with all VISA, Mastercard and other credit cards. Security systems are used to prevent members' credit card information from being seen by third parties in their shopping. sunpa.com.tr does not store any customer credit card information regarding the shopping members in its system. A maximum of four different shopping transactions can be made on the same day with the same credit card. For security reasons, you will be asked to enter the three-digit security code (CVC Number) of the credit card during the order. The security code is the three digits on the back of the credit card, after the credit card number in the signature box. When the purchase is confirmed, the shopping amount (including taxes and other costs) is charged to the credit card used for the payment. It is not obligatory for the credit card to belong to the shopping member. Credit card installments may vary depending on the card and the bank. Information is given about whether there is an installment option and the number, if any, during shopping. Credit card payment may not be confirmed at checkout due to different reasons. "Could not get authorization" message is received for reasons such as limit exceeded, incorrect information entry, expired date of use, incorrect or incomplete security code entry, temporary connection problems during the approval process, and a lost/stolen card. Upon this message, which means that the payment confirmation has not been completed, a connection should be made with the relevant bank without sharing the card information with third parties.
Sunpa.com.tr has no responsibility for the payment being not approved for any reason, illegal card usage and the credit relationship between the member and the bank. The current prices of sunpa.com.tr at the time of purchase are valid for shopping / purchasing products / services. After the payment transaction is confirmed by sunpa.com.tr, your invoice will be issued and sent to the address you specified during the transaction, by registered mail. You accept and declare that the address information you have specified is up-to-date and correct and that the notifications to this address will be valid. sunpa.com.tr may share your payment information with public institutions or third parties that it thinks are related to the violation, in case of existence or suspicion of illegal acts.

III. Delivery

Delivery: Deliveries are made only in the form specified in the order, to the specified address and to the person/member/customer who made the payment. The invoice is issued in the name of the person paying the bill. Accurate and timely delivery depends on the accuracy and clarity of the address given by the customer. The customer/member is responsible for providing the correct address.
Delivery Time/Service Start Time: sunpa.com.tr will forward your order to the Service Provider/Manufacturer company after the payment process is completed and the relevant amount is transferred to the sunpa.com.tr account, and the service subject to payment will be started by the Service Provider/Manufacturer company. Delivery/service will begin immediately after order confirmation/processing/activation and payment. Different delivery times depending on the type of delivery or the nature of the product are subject to the conditions written in the approved order. Orders made/confirmed at the weekend are recorded in the system as if they were made on the first day of the next week.
Stock Status: After the order is confirmed, possible delays due to problems caused by suppliers/service/access companies are communicated to the customer via the contact information given to them. Sunpa.com.tr cannot be held responsible if the contact information is not given correctly during the ordering or the customer cannot be reached due to changes that may occur.

Except for the above-mentioned payment options, there is no payment method such as payment at delivery/address or hand payment unless otherwise stated. Payment should not be made as specified.

IV. Cancellation/Refund/Warranty

Legal Rights: The written provisions in these general conditions are specific to sunpa.com.tr and reflect the return and cancellation conditions of sunpa.com.tr. The special conditions of sunpa.com.tr written here do not affect the rights of the Customer/Member specified in the Law No. 4077 on Consumer Protection.
No Special Commitment: sunpa.com.tr does not have a special return commitment other than the conditions written here and the mandatory mandatory rights recognized in the law. Campaign conditions apply for special or product-based campaigns.
Warranty: There is no special warranty commitment for the products and services purchased from sunpa.com.tr, except for the products and services under the guarantee of the manufacturers/importers and suppliers other than sunpa.com.tr and the products that are legally accepted under warranty. The warranty period is limited to the time allowed by the manufacturer/importer and the supplier for the products and services under warranty. In order to determine the warranty conditions, the warranty certificate, promotional guide or product brochures, if any, presented with the product should be carefully examined. If any, the relevant manufacturer/importer or supplier companies should be consulted for malfunctions that may occur under warranty.
Right of Withdrawal: The customer has the right to withdraw from the order/shopping/contract by rejecting the goods or services within 7 (seven) days from the confirmation of the order or the date of receipt of the product without any legal or criminal liability and without giving any reason. com.tr undertakes to take back the goods from the date on which the notice of withdrawal is received. The product purchased for return should be returned as received (gift, promotion, accessories, mounting elements, packaging, original box must be delivered) within seven (7) days from the date of receipt, without using the product and packaging, if any can be done. The return is made to the address on the invoice with the delivery note of the product, the original product invoice and a letter containing the reason for the return. Products that do not receive the original of the waybill and invoice for the return will not be returned. Return costs are the responsibility of the customer. The right of withdrawal cannot be exercised regarding the products and services that are instantly sold, provided and offered electronically via sunpa.com.tr, as well as the goods delivered to the customer immediately, and the goods prepared in line with the customer's wishes or clearly his personal needs. Contracts regarding such goods and services are not subject to the provisions regarding the right of withdrawal and use.
Complaints and Applications: The customer can make his applications regarding the complaints and objections regarding the purchased goods, within the monetary limits determined by the Ministry of Science, Industry and Technology in December every year, to the arbitral tribunal or the consumer court for consumer problems in the place where he purchased the goods or services or where his residence is located.
Returns: Unless otherwise stated, returns are not accepted for products and services sold, provided and offered electronically over sunpa.com.tr.
Non-Returnable Products: The return of copyrighted/licensed products is only possible provided that the original packaging is unopened and intact, otherwise only the same product can be exchanged.
Defect: The legal rights of the Member/Customer regarding the defective product/defective services in the Law No. 4077 on the Protection of the Consumer are reserved, and their use is subject to the conditions specified in the law.
Change and Follow-up: sunpa.com.tr reserves the right to change the sales conditions or bring additional conditions at any time without prior notice. Since sunpa.com.tr reserves the right to make changes in the sales conditions, it is necessary to regularly monitor and read the conditions before each shopping/use. The use or shopping of this site and its services after such a change means that the changes in question are accepted. sunpa.com.tr reserves the right to terminate the publication of the site in general, to close it, to partially or completely change all the content, services and similar elements on the site, and to disable them without prior notice.
Records: In case of disputes that may arise from the Terms of Sale, all kinds of computer records, including the books and communication logs of sunpa.com.tr, and e-mail and fax notifications made by sunpa.com.tr to customers constitute definitive and exclusive evidence.
Applicable Provisions: Laws of the Republic of Turkey are applied in disputes that may arise regarding the use of the site.
Authorized Courts and Enforcement Offices: Istanbul (Central) Courts and Enforcement Offices will be authorized to resolve any disputes that may arise regarding the terms of sale.
